The website www.lajoliegirafe.com and all items for sale are the property of Nathalie Vincent. The patterns for sale are only for private use and not for commercial and/ or collective use. Each model is submitted to the INPI.

This site and the patterns offered for download are intended for a particular use. For any professional approach, please contact me through the contact form.

Article 2 – Purpose

These conditions are intended to define the terms of sale between La Jolie Girafe and the customer, from the order to the services, through payment and delivery. They regulate all the necessary steps to place the order and ensure the follow-up of this order between the contracting parties.

Article 3 – Product

La Jolie Girafe aims to offer sewing patterns, fabrics, haberdashery accessories and all other products related to sewing, within the limits of available stocks. These products are those listed for sale on the day of consultation by the user. When the product is unavailable, it is displayed on the site, otherwise, in case of error, La Jolie Girafe undertakes to notify the customer by email as soon as possible. If the product has already been paid, La Jolie Girafe undertakes to refund the customer the price of the item. The products offered for sale are described and presented as accurately as possible. However, if errors or omissions may have occurred with regard to this presentation, La Jolie Girafe cannot be held liable. Photographs and texts illustrating the products do not enter the contractual field.

Article 4 – Prices

Prices are indicated in Euro TTC. They take into account the French VAT, applicable on the day of the order. If the VAT rate changes, these changes will be reflected in the price of the items.

La Jolie Girafe reserves the right to change its prices at any time. However, these prices could not be modified once the order is validated. The prices indicated do not take into account the shipping costs that will be added to the total of the order and will be specified to the customer during the final validation of his order. Delivery in Metropolitan France is made within an average of 2 to 7 days for a product in stock from the receipt of the order by La Jolie Girafe, obstinate any case of unforeseen circumstances or force majeure that would delay delivery regardless of the will and diligence of La Jolie Girafe. The amount depends on the country of delivery. The products remain the property of La Jolie Girafe until the perfect payment of the price.

Article 5 – Order

Order Registration

The customer who places an order directly on www.lajoliegirafe.com will have to follow the following procedure: The customer will choose the different products to which he has an interest and will click successively on the link «Add to my cart». At any time he will have the possibility: Either to obtain a summary of the selected products by clicking on the link «My cart» or to continue his purchases. The customer will complete their order by clicking on “Continue Order”.

In order to correctly validate his order. He then specifies the delivery method chosen according to the country. The order can only be registered on the website if the customer has clearly identified himself by entering his email address and password which are strictly personal to him. Once the user identified, he must validate the delivery address then a purchase order will appear summarizing: the nature, quantity and price of the products retained by the user, as well as the method of payment chosen, the contact details of the user and the delivery address of the package. Any order constitutes acceptance of the prices and description of the products available for sale.

Order Validation

The order is validated once read and approved the General Conditions of Sale and all fields completed by the customer. The order is final when the customer clicks on «validate» Payments are made by Paypal, Stripe or by post (cheque). La Jolie Girafe will acknowledge receipt of the order as soon as it is validated by email.

Downloadable products (digital patterns) are available for download via a link attached to your electronic invoice, after ordering and validation of payment.

Article 6 – Payment and Security

The amount due by the customer is the amount indicated in the order confirmation of La Jolie Girafe.

Purchases on www.lajoliegirafe.com are 100% secure thanks to the implementation of payment control and security systems. Communicating your credit card number on the bank server at the time of payment of your order is completely secure. Indeed, this manipulation carries no risk since the details of your credit card never pass in clear on the network: they are encrypted thanks to the SSL protocol (Secure Socket Layer).

La Jolie Girafe does not have access to your bank details, and does not keep them on its servers. This is why they are requested again with each new transaction on our site. Communicating your credit card number on the site is completely secure. On the other hand, it is possible that a malicious person can obtain your credit card number (for example in case of theft), and use it to place an order without your knowledge.

In any case, La Jolie Girafe reserves the right to refuse any order or delivery in case of existing dispute with the customer, total or partial non-payment of an order, a credit card payment refused or for reasons other than La Jolie Girafe reserves the right to explain to its customer. The responsibility of La Jolie Girafe can then in no way be engaged in this respect.

When the order is validated, the payment request is routed in real time on the secure payment manager. The electronic payment manager issues an electronic certificate.

Article 7 – Guarantees and withdrawal

Some products do not allow the use of the right of withdrawal because of their personalized, dematerialized or fixed date.

Thus, products for cutting, digital products and sewing workshops reserved, may not be subject to the right of withdrawal in accordance with article L121-21-8 of the Consumer Code

“The right of withdrawal cannot be exercised, for contracts:

(…) 3° Supply of goods made to the specifications of the consumer or clearly personalized …”.

(…) 12) Provision of accommodation services, other than residential accommodation, services for the transport of goods, car rentals, catering or leisure activities which must be provided on a specified date or period; 

(…) 13) The provision of digital content not supplied on a physical medium whose performance began after express prior consent of the consumer…”.

For products that may be subject to a right of withdrawal, the exchange or refund must occur within 14 days from the date of receipt or withdrawal.

The return of the item(s) within this period must be made in its original packaging to the following address:

It is essential that the customer makes a return request by email (nathalie@lajoliegirafe.com) in order to obtain a return authorization. Will be refused by the seller any damaged item that has not been the subject of remarks or express reservations by the customer upon delivery. To be accepted by La Jolie Girafe items must be returned in their original condition without having been processed, modified, washed, worn. Only items returned in their original packaging (Kraft return envelope) will be accepted. As a result, returns of modified and/or altered items, as well as damaged packaging will be refused. La Jolie Girafe reserves the right to accept or refuse the returned item according to its qualitative condition. All articles are subject to a contractual guarantee, which does not prevent the legal guarantee provided by articles 1641 and following of the Civil Code. The user benefits from a guarantee for the articles allowing him to return the articles delivered defective in accordance with articles L 211-4 and following of the Code of consumption.

In case of cancellation of reservation for a workshop, individual course, pair, individual or collective, the customer can notify La Jolie Girafe at 06 83 84 45 44 or by mail at nathalie@lajoliegirafe.com.

If the cancellation takes place more than 72 hours before the start of the workshop: there is no hold, the session will not be counted.
If the cancellation takes place less than 72 hours before the start of the event: The session will be counted, fully due and non-refundable.

La Jolie Girafe reserves the right to postpone any workshop or course, in case of failure of a speaker, lack of registrants, or inability to perform the service. The sessions will not be counted or due.

Covid-19 measures: measures to close or restrict access to the workshop will not give right to any reservation refund or gift voucher. Classes will be postponed. Gift certificates will be extended for the duration of the closure.

The exchange:

Items subject to the right of withdrawal from www.lajoliegirafe.com are exchangeable subject to stock availability. Simply mention the desired item in exchange during your return request. We will accept it upon receipt of your return, subject to availability. If the new order is of a higher amount, the customer will have to attach to the exchange request the payment of the balance by check. Conversely, if the amount of the exchange is less than the initial amount, the customer will receive a refund of the difference directly to his account.

To return an item, simply follow these instructions: Send an email to «nathalie@lajoliegirafe.com» and wait for a return authorization.
Use the original packaging to return the product.
Send your parcel to the following address: SARL La Jolie Girafe – 70 chemin de Mappaz 74520 Chênex France. The return costs are the responsibility of the Customer.

The refund:

Physical products

Refunds will be taken into account with the products delivered. La Jolie Girafe undertakes to reimburse within a maximum of 30 days by credit card or cheque at the customer’s discretion. If you would like a refund, please send an email to «nathalie@lajoliegirafe.com». Enter your name, first name, phone number, order number and the reason for your return. Return the parcel by mail to La Jolie Girafe at the following address: 70 chemin de Mappaz 74520 Chênex France. Please note that we do not accept packages addressed in postage due.

Attention: You will be re-credited the amount of your order, less the initial shipping costs. However, the customer must return the item in its original packaging and must be returned with the permission of La Jolie Girafe.

In any case, any request for exchange or refund must be made by e-mail («contact» section). All articles are subject to a contractual guarantee, which does not prevent the legal guarantee provided for in articles 1641 and following of the Civil Code.

Colorometry: the colors of the physical products offered on the site of the pretty giraffe depend on the personal computer settings of the customer. The colors can therefore be different depending on the medium and the settings used. For these reasons, La Jolie Girafe does not undertake to take back, exchange or refund physical products that do not meet an expectation based on colorometry criteria.

Virtual Products:

Downloadable products (digital patterns) are not subject to this method of return. The right of withdrawal does not apply to digital products that can be downloaded directly from the websites, if the product has been downloaded at least once.
If the Product has never been downloaded, the customer has 7 days from receipt of the ordered Products to return them to La Jolie Girafe for exchange or refund.
In case of exercising the right of withdrawal, La Jolie Girafe undertakes to refund the sums paid by the customer, without charge, within a maximum period of 30 days.
If the product has already been downloaded, La Jolie Girafe undertakes to refund or exchange the damaged Digital Products, including hidden defects or not corresponding to the description offered on the Site.

Article 8 – Delivery

Shipping/ delivery times

Physical products are shipped to the delivery address indicated by the customer when ordering. All validated orders are shipped within 2-5 days. In case of unusual shipping delay, an email will be sent to you.

The delivery times indicated are the indicative delivery times of our carriers in working days. 

The tracked Colissimo is delivered by La Poste. It is delivered to the delivery address indicated on your order summary.

The Mondial Relay and the chronoshop2shop are delivered to the address of the relay point indicated on your order summary.

The delivery times indicated are indicative from the day following that of the shipment of the order and correspond to the processing and delivery times of the products. Under no circumstances can they be opposable. La Jolie Girafe therefore declines any responsibility in the event of an excessive delivery time due to postal services or means of transport, as well as in the event of loss of ordered products or strike. The risks of transport are borne by the customer, who must file a reasoned complaint with the postal services or the carrier, within three working days of delivery.

Virtual products: after confirmation of the Order and subject to payment of the price of the products ordered, La Jolie Girafe undertakes to send its customer a link to the product to download in PDF format to the delivery email address within 7 working days.
Upon receipt of payment of the order, this link is available:
– by email received at the email address of the Customer registered in his account.
– in the order history found in the Customer’s account in the online store, provided that the customer has created an account.
Downloads are unlimited in duration and limited to 5 downloads, but the Customer is asked to save his files.Absence / Non retrait du colis physique

In case of absence for a Colissimo delivery, the postman leaves you a notice of passage, indicating the conditions of withdrawal of your package (place and deadlines). The processing time is generally 14 days. You can follow the progress of your package on the La Poste website.

If you do not collect the package within the time limit, it is returned to the sender.

In case of request for refund or re-delivery of the package not returned, La Jolie Girafe will apply a flat rate processing fee of 6 €. To see the products eligible for reimbursement, refer to Article 6 of these GTC.

For Mondial Relay and chronoshop2shop parcels, these remain available in relay point for 8 days. If you do not collect the package within the time limit, it is returned to the sender.

In case of request for refund or re-delivery of the package not returned, La Jolie Girafe will apply a flat rate processing fee of 6 €. To see the products eligible for reimbursement, refer to Article 6 of these GTC.

Damage / Missing Product

Despite all the care taken by La Jolie Girafe in the preparation of packages, it is possible that a product is missing. Similarly, after transport of the package, one of the products may be defective. Therefore, upon receipt of the order, the customer will ensure to check the conformity of the products received. Any anomaly concerning the delivery (missing or broken product, damaged package) must be notified, the same day of receipt or at the latest the first working day after receipt, to the customer service of La Jolie Girafe by email (nathalie@lajoliegirafe.com) or recommended (addressed to SARL La Jolie Girafe 70 chemin de Mappaz 74520 Chênex).

Any claim made after this period will be rejected and La Jolie Girafe will be released from any responsibility. La Jolie Girafe reserves the right to ask the customer to return the defective product. If the aforementioned conditions are met, La Jolie Girafe will then proceed with the exchange, the refund of the defective Product(s), or the return of the missing product (subject to the merits of the Buyer’s request).

Damaged parcel: We ask you not to receive a damaged parcel (cardboard with visible traces of opening and/ or deterioration): it must be refused. Indeed, the parcels leaving the warehouses of La Jolie Girafe are always impeccable, and must be delivered to you in this state. If a damaged package has been deposited in your mailbox or received by your custodian, the package is considered “accepted as is”. If no reservation has been made, we will not be able to take into account the possible disappearances, nor to proceed to compensation.

Article 9 – Intellectual Property

All elements of the site www.lajoliegirafe.com such as physical or virtual products, visuals, including the underlying technology, are protected and any fraudulent use will be prosecuted. They are the exclusive property of La Jolie Girafe.

All content on www.lajoliegirafe.com is the intellectual property of Nathalie Vincent. No reproduction of content, even partial, may be made without the prior consent of the author.

All original La Jolie Girafe patterns are deposited at the INPI.

La Jolie Girafe Patterns are intended for private and personal use. Any copy, free or paid distribution, commercial exploitation is prohibited and illegal.

The user who has a personal website and who wishes to place, for personal use, on his website a simple link directly to the site of La jolie Girafe, must quote the company and describe its activity. On the other hand, any hypertext link to the site of La jolie Girafe and using the technique of framing, deep-linking, in-line linking or any other deep-linking technique is in any case strictly prohibited. In any case, any link, even tacitly authorized, must be removed on request of La Jolie Girafe. Hyperlinks may link to sites other than www.lajoliegirafe.com. The latter disclaims any responsibility in the event that the content of these sites would violate the laws and regulations in force.

Article 10 – Informatique et libertés

La jolie Girafe reserves the right to collect personal data from users of the site, particularly through the use of “cookies,” for the purposes of its activities. You can find detailed information about our data privacy policy on the Personal Data page.

To this end, the automated processing of information, particularly the management of user email addresses, has been declared to the CNIL (French Data Protection Authority), as stipulated in the legal notices of the site.

In any case, and in accordance with the law of January 6, 1978, the consumer also has the right to access and rectify any information concerning them in the files of the company La Jolie Girafe. Any site customer can at any time object to the commercial use of such data and also has the right to access, rectify, and delete data concerning them directly on the Internet via the contact section of the site by selecting the subject “GDPR”.

Article 11 – Signature and Proof

In any case, providing the online credit card number and the final validation of the order will constitute proof of the entire said order in accordance with the provisions of the law of March 13, 2000, and will render the amounts engaged by entering the items on the order form due. This validation constitutes a signature and express acceptance of all operations carried out on the site.

However, in the event of fraudulent use of their credit card, the customer is invited, upon noticing such use, to contact the customer service of La Jolie Girafe by sending an email to nathalie@lajoliegirafe.com.

The computerized records kept in the computer systems of La Jolie Girafe and its partners under reasonable security conditions will be considered as evidence of communications, orders, and payments made between the parties. In any case, the validation of the order, whether payment is made by credit card directly on the site, constitutes a signature and express acceptance of all operations carried out on the site.

Article 12 – Customs Duties

Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the responsibility of the customer. La Jolie Girafe is not obligated to verify and inform its customers of applicable customs duties and taxes.

To know them, it is the member’s responsibility to inquire with the competent authorities of their country.

Article 13 – Entire Agreement

These general terms and conditions of sale and the order summary sent to the customer form a contractual whole and constitute the entirety of the contractual relations between the parties.

Article 14 – Applicable Law

The language of these general terms and conditions of sale is French. This contract is subject to French law. In the event of a dispute with a customer, only French courts will have jurisdiction.
